Bondsi.com, Inc. End-User Agreement

Your use of this website constitutes an agreement to be legally bound by the terms and conditions contained within this Agreement. The content on this site, including these terms and conditions, is subject to change. Additional terms and conditions of use applicable to specific areas of the website may also be posted in such areas. If at any time the terms and conditions are no longer acceptable to you, you should immediately cease all use of the website.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY.

1. NEITHER BONDSI.COM NOR ANY THIRD PARTY OR THEIR RESPECTIVE AGENTS WARRANTS THAT BONDSI.COM WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES BONDSI.COM, ANY THIRD PARTY OR THEIR RESPECTIVE AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF BONDSI.COM. NEITHER BONDSI.COM, THIRD PARTIES AND NOR THEIR RESPECTIVE AGENTS MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO BONDSI.COM, OR ANY CONTENT MADE AVAILABLE
THROUGH BONDSI.COM. BONDSI.COM NOR ANY THIRD PARTY WARRANTS THAT
BONDSI.COM NOR ANY INFORMATION AVAILABLE WITHIN IT WILL BE FREE OF VIRUSES OR SIMILAR CONTAMINATION OR DESTRUCTIVE FEATURES. YOU EXPRESSLY AGREE THAT THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF BROKERAGE BUILDER AND THE ACCURACY OR COMPLETENESS OF THE SERVICE IS ASSUMED SOLELY BY YOU.

2. NEITHER BONDSI.COM, ANY THIRD PARTY NOR THEIR RESPECTIVE AGENTS SHALL BE LIABLE FOR ANY
DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF
OR INABILITY TO USE OF BONDSI.COM, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.

3. SOME STATES DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR
INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT
APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF BONDSI.COM, THIRD PARTY AND THEIR RESPECTIVE
AGENTS SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

4. Disclaimers.  Nothing contained in this Agreement shall confer upon a user any right, title, or interest in, or license to any software, written materials or intellectual property owned by Bondsi.com Inc.

5. Liabilities. You agree to indemnify, defend and hold Bondsi.com and its respective officers, directors, owners, agents, information providers and licensors (collectively, the "Bondsi.com Parties") harmless from and against any and all claims, liability, losses, costs and expenses (including attorneys' fees) incurred by any Bondsi.com Party in connection with any use or alleged use of the Website under your password by any person, whether or not authorized by you. Bondsi.com reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with Bondsi.com's defense of such claim.

6. User Fees. The user acknowledges that BONDSI.COM is offered as a convenience to the user so that the user may print selected license and permit bonds at their business or home office location. This provides the end user with significant savings in time and convenience, and avoids the end user from waiting for mail delivery of said bonds, or unscheduled pick-ups from an insurance agency to obtain a bond. User further acknowledges that Bondsi.com incurs costs in providing this service to the end user, including but not limited to, website hosting fees, programming expense, credit card maintenance and processing fees, and other administrative expenses. In order to compensate bondsi.com for these extra expenses, on behalf of the user, a user fee of $50 per bond is applied to all license and permit bonds with face amounts of less than $15,000. For bond amounts at $15,000 or greater, no fee is applied. The user acknowledges that the user understands that Bondsi.com charges this fee as previously applied and agrees to pay this fee in exchange for the convenience and time savings associated with the use of Bondsi.com.

7. Miscellaneous. This Agreement shall be construed in accordance with the laws of the State of Illinois, and the parties irrevocably consent to bring any action to enforce this Agreement in the federal or state courts. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all previous written or oral agreements between the parties with respect to such subject matter. If any inconsistency exists between the terms of this agreement and any additional terms and conditions posted on the Website, such terms shall be interpreted as to eliminate any inconsistency, if possible, and otherwise, the additional terms and conditions shall control.
